Terms of Service
These Terms of Service (the "Terms") govern your use of the Photo Editor mobile application (the "App"), developed and operated by Youngware (the "Developer", "we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Use of the App
The App is a photo editing tool that allows you to edit images stored on your device. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on a device you own or control.
You agree not to:
- Copy, modify, distribute, sell, lease, or sublicense the App or any part of it;
- Reverse engineer, decompile, or disassemble the App, except to the extent permitted by applicable law;
- Use the App in any way that violates applicable laws or regulations;
- Use the App to create, edit, or distribute content that is unlawful, infringing, defamatory, or harmful;
- Interfere with or disrupt the operation of the App or the servers and networks used by the App and its third-party services.
2. Your Content
The App processes photos on your device. You retain all rights to the photos you edit with the App. We do not claim any ownership of your content, and your photos are not uploaded to our servers.
You are solely responsible for the content you edit and for how you use or share the resulting images. You represent that you have the necessary rights to any photos you edit with the App and that your use of them does not infringe the rights of any third party.
3. In-App Purchases and Subscriptions
The App may offer optional paid features through in-app purchases and subscriptions, processed by the app store from which you downloaded the App (e.g., Google Play).
- Prices are shown in the App before purchase and may vary by region.
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel subscriptions in your app store account settings.
- Payments are charged to your app store account. Refunds are handled in accordance with the app store's refund policies and applicable law.
- We may change the price or scope of paid features; changes will not apply retroactively to periods you have already paid for.
4. Advertisements
The App may display advertisements provided by third-party advertising services. Advertisements are part of how we keep the App available free of charge. Your interactions with advertisers are solely between you and the advertiser, and we are not responsible for the content of advertisements or the products or services they promote.
5. Intellectual Property
The App, including its software, design, graphics, and other content provided by us (excluding your photos), is owned by the Developer or its licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in these Terms, no rights in the App are granted to you.
6. Privacy
Your use of the App is also governed by our Privacy Policy, which describes how information is collected and used in connection with the App.
7. Updates and Availability
We may update, modify, suspend, or discontinue the App or any of its features at any time, with or without notice. We do not guarantee that the App will always be available, uninterrupted, or free of errors, or that it will be compatible with every device or operating system version.
8. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
You are responsible for backing up your photos. To the maximum extent permitted by law, we are not responsible for any loss of, or damage to, your photos or other data arising from your use of the App.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP. IN ANY CASE, OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP OR ITS PAID FEATURES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.
10. Termination
These Terms are effective until terminated. We may suspend or terminate your access to the App at any time if you breach these Terms. You may terminate these Terms at any time by uninstalling the App. Sections that by their nature should survive termination (including Sections 2, 5, 8, 9, and 11) shall survive.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Developer resides, without regard to its conflict of law provisions. Nothing in these Terms limits any mandatory consumer protection rights you may have under the laws of your country of residence.
12. Changes to These Terms
We may revise these Terms from time to time. Changes will be posted on this page with an updated effective date. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
